Terms & Condition

A brief overview of these terms and conditions is submitted with project quotations, and it must be agreed upon prior to any work being carried out on the project. Payment of an advance fee or making a payment online constitutes acceptance of our terms and conditions. Alternative payment methods are available. These terms and conditions are assumed to be accepted by you. You are suggested to use Pristinit Solutions only if you have agreed to all of the terms and conditions listed on this page. You are responsible for creating a complete backup of all content on the website before allowing Pristinit Solutions to proceed with the necessary steps to fulfil the contract terms. Pristinit Solutions shall assume no responsibility in the event of a loss or damage to existing data under any circumstances.

Payments

An invoice for the initial setup fee will be issued at the start of the project to cover the cost of the Service. Upon completing the Development, Design, and any associated services, Pristinit Solutions will issue a final invoice to the customer. The size of the project and the agreed-upon milestones will determine whether or not intermediary milestone invoices will be issued. Invoices are normally sent via email. However, the Client may choose to receive hard copy invoices if they prefer that method of communication. All invoice payments are due on the day they are issued. The final invoice must be received before the completed app can be submitted to the Appstore, and the source code can be made available. Pristinit Solutions can consider the account to be in default if the invoice has not been paid within thirty days of receipt.

Termination

The Client's request to terminate the project must be made in writing or via email, and the termination will become effective upon receipt of the notice. Requests for service termination made over the phone will not be honoured until and unless they are confirmed in writing or via email. The Client will be invoiced for design and development work completed up to the date of the first notice of cancellation and will be required to pay the invoice in full within fourteen days of receipt of the invoice.

Refund

A refund will be issued if the Client cancels the project before any deliverable work has been completed. This includes any deposits paid prior to the project's start date. Cancelling the project after signing the contract and making an advance payment may result in the loss of a portion or all of the paid-up amount, depending on the level of completion at the time of cancellation. All project cancellations should be communicated to Pristinit Solutions in writing at least 30 days prior to a project lasting more than three months. There will be an execution fee of at least 20% applied to cancelled projects to cover the costs incurred during the project strategizing, scheduling, and execution.

Copyright

All data, files, and graphic logos provided by the Client remain the Client's exclusive property; however, Pristinit Solutions is granted permission to publish and use such materials. The Client is responsible for obtaining permission and rights to use any information or files protected by a third party's intellectual property rights. The Client is also responsible for granting Pristinit Solutions permission and rights to use the materials in question. The Client agrees to indemnify Pristinit Solutions and harmless from and against any claims arising from the Client's negligence. When signing a contract for App design and development, the Client warrants to Pristinit Solutions that they have obtained all necessary permissions and authorities on their behalf before beginning work. Possibilities exist that documentation demonstrating permissions and authorities will be required.

Jurisdiction

These Terms and Conditions are governed by the laws of the Government of India and are subject to the exclusive jurisdiction of the Courts of Ahmedabad in all disputes arising out of or in connection with them. Any dispute that may arise between the two parties regarding the interpretation or application of the contract shall be subject to the laws of the Government of India and the jurisdiction of the courts of India.
